2. Purpose and acceptance

These terms govern the sale, on zodily.com, of Zodily's paid digital content and services to consumers. They are available at any time from the footer of every page and next to every payment button. Paying means accepting the terms in force on the date of the order.

3. What is sold

Zodily gives online access to the full compatibility reading of a couple (a detailed analysis based on the signs and birth dates entered) and to the readings and content reserved for members. This is digital content supplied without a physical medium. Readings are for entertainment and personal reflection: they are not medical, psychological, legal or financial advice, nor a guaranteed prediction.

Plans offered, depending on availability at the time of the order:

Full compatibility report: €19 once. No subscription, nothing to cancel.

Monthly subscription: €12.99 per month, cancel anytime.

Yearly subscription: €89 per year, cancel anytime.

Weekly plan: €1 today. Then €9/week until cancelled. The first euro covers the first week; weekly billing starts on day 8.

4. Prices

Prices are in euros, all taxes included. VAT is not applicable (article 293 B of the French General Tax Code): the amount shown is the total amount paid, with no additional fees from us. Your bank may charge conversion fees if your card is not in euros. The applicable price is the one shown when you order; any change to the price of an ongoing subscription would be announced by email at least 30 days in advance, with the option to cancel before it applies.

5. Order and payment

Orders are placed online: choose a plan, then pay by card on the secure page of our provider Stripe. You can check the amount and correct your entries before confirming. The contract is concluded when Stripe confirms the payment; a receipt is sent to the email address entered at payment. Card data is processed by Stripe and never passed on to us.

6. Access to the content

Access opens immediately after the payment is confirmed, on the device used. You can recover it on any device from "My space", with the email address used to pay. A subscription gives access to the content for the whole period paid for.

7. Subscriptions: renewal and cancellation

Subscriptions (weekly, monthly, yearly) renew automatically at the end of each period, at the same price, charged to the card used, until cancelled.

You can cancel at any time, free of charge and without giving a reason, in a few clicks from "My space", or by writing to ads.ericgerard@gmail.com. Cancellation takes effect at the end of the period already paid for: you keep access until that date and nothing is charged afterwards. A cancellation confirmation is sent to you by email. The current period is not refunded pro rata, except in the cases set out in sections 8 and 9.

8. Right of withdrawal

As a rule, consumers have 14 days from the conclusion of the contract to withdraw (article L221-18 of the French Consumer Code).

However, Zodily supplies digital content without a physical medium, whose performance starts as soon as you pay. Under article L221-28 13° of the French Consumer Code, the right of withdrawal cannot be exercised once the consumer has requested this immediate performance and expressly waived the right of withdrawal. This request and waiver are collected by the notice placed next to every payment button, on our site and on the Stripe payment page, before any confirmation. The payment receipt and these terms keep a record of it.

If you could not access the content you bought for a reason attributable to us, write to us: we restore access or, failing that, refund you in full.

9. Legal guarantee of conformity

The digital content supplied is covered by the legal guarantee of conformity (articles L224-25-1 and following of the French Consumer Code): for two years for a one-off supply, and for the whole subscription for a continuous supply. If there is a defect, you are entitled to have it fixed free of charge or, if that is impossible or not done within a reasonable time, to a price reduction or to termination of the contract with a refund. Report the defect to ads.ericgerard@gmail.com.

10. Liability

We do our best to keep the site available, but cannot guarantee uninterrupted availability (maintenance, host or network outage). We cannot be held liable for personal decisions made on the strength of a reading, which remains entertainment content.

11. Personal data

The data needed for the order (email address, payment information processed by Stripe) is used to perform the contract, give access to the content and meet our accounting obligations. It is neither sold nor transferred. You have the right to access, correct and delete it by writing to ads.ericgerard@gmail.com, and may lodge a complaint with the CNIL (cnil.fr) or your local data protection authority.

12. Customer service and complaints

For any question or complaint: ads.ericgerard@gmail.com. We reply within 7 working days at most.

13. Consumer mediation

If a written complaint sent to customer service has not been resolved within two months, you may refer the matter free of charge to a consumer mediator (articles L612-1 and following of the French Consumer Code).

The appointment of our consumer mediator is in progress; their details will appear here as soon as we have joined. Until then, every written complaint receives a reply within 7 working days.

If you live in another European Union country, the European Consumer Centre France (europe-consommateurs.eu) can help you free of charge with a cross-border dispute.

14. Governing law

These terms are governed by French law. If you live in another country, you keep the benefit of the mandatory consumer protection rules of your country of residence. If no amicable solution is found, the dispute may be brought before the court with jurisdiction under the legal rules, in particular the court of your place of residence.
